Differing factual circumstances also may impact an opinion’s applicability to a new situation. Furthermore, the United States Supreme Court’s decision in Republican Party of Minnesota v. White, 536 U.S. 765, 122 S.Ct. 2528, 153 L.Ed.2d 694 (2002) continues to have ramifications on Canon 5 and the conduct of judicial elections. Over the next several months, the JEC will be undertaking a review of all previous JE opinions with a view as to whether they are still valid, and will be submitting a report to the Kentucky Supreme Court.
